Welcome to Free Text Editor, a software application owned and operated by Prestomedia, LLC (“Prestomedia,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the Free Text Editor application (“App”), which integrates with Google Drive™.

By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Eligibility

The App is intended solely for use by adults. By using the App, you represent and warrant that you are at least 18 years of age, or the age of majority in your jurisdiction, and have the legal capacity to enter into these Terms.

Description of Service

Free Text Editor is a free software-as-a-service (SaaS) application that allows users to create, edit, and manage text files directly within Google Drive™. Features include, but are not limited to, Monaco Editor integration (similar to Visual Studio Code), conflict detection and merging, and passphrase encryption.

Passphrase Encryption and Data Loss Warning

The App offers a feature to encrypt your text files using a passphrase via OpenPGP (stored as Radix-64 PGP ASCII Armor).

No Passphrase Storage: Passphrases are processed on-the-fly strictly to encrypt or decrypt your files. Prestomedia does not transmit, log, or store your passphrase anywhere on our servers.

Risk of Data Loss: IF YOU FORGET OR LOSE YOUR PASSPHRASE, YOUR DATA CANNOT BE RECOVERED. Prestomedia has no back-door access, recovery keys, or ability to retrieve or reset your passphrase. You assume full responsibility for remembering your passphrase and accept all risks of permanent data loss if it is forgotten.

Privacy and Data Storage

Your use of the App is subject to our Privacy Policy. The App is designed so that your file content is saved exclusively to your own Google Drive™ account. Prestomedia does not host, store, or process your file content on its own databases. While we strive to build software compatible with strict privacy laws (such as GDPR or CCPA), it is your sole responsibility to ensure that your use of the App complies with the privacy laws applicable to you and the data you are processing.

Disclaimer of Warranties

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. PRESTOMEDIA MAKES NO GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, BUG-FREE, SECURE, OR WORKING AS INTENDED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRESTOMEDIA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOUR USE OF THE APP IS AT YOUR OWN RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRESTOMEDIA, LLC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA (INCLUDING LOST OR UNRECOVERABLE ENCRYPTED FILES), USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. YOU AGREE TO HOLD PRESTOMEDIA HARMLESS FROM ANY AND ALL CLAIMS ARISING OUT OF YOUR USE OF THE APP.

Intellectual Property

Free Text Editor and its original content, features, and functionality are and will remain the exclusive property of Prestomedia, LLC. You retain all ownership rights to the files and content you create and edit using the App.

Modifications to the App and Terms

Prestomedia reserves the right to modify, suspend, or discontinue the App (or any part thereof) at any time without notice. We may also revise these Terms from time to time. The most current version will always be posted on our website. By continuing to use the App after revisions become effective, you agree to be bound by the revised Terms.
